1. Scope of application
These Terms and Conditions apply to all contracts, offers, deliveries and services between Tanksanierung Sager and the customer.
Deviating or conflicting terms and conditions of the customer shall not be recognised unless we expressly agree to their validity in writing.
2. Offers and conclusion of contract
Our offers are non binding and subject to change. A contract is only concluded upon our written order confirmation, by return of an order or shipping request confirmed by us, or by performance of the service.
Price information is a guideline. The actual effort may vary depending on the condition of the tank, internal condition, old coating, heavy corrosion, fuel residues or special shape.
Identifiable additional work will be agreed with the customer before the additional work is carried out.
3. Prices and payment terms
All prices are stated in euros including the applicable statutory value added tax, unless expressly stated otherwise.
Payment is usually made in advance, by bank transfer or by PayPal. Other payment methods are only possible by prior agreement.
Additional and extra work, for example chemical stripping, removal of old internal coatings, repeated rinsing, additional manual work, welding work or disassembly and assembly of attached parts, will be charged separately.
In the event of late payment, the statutory provisions apply.
4. Delivery, processing time and shipping
Delivery and processing times are agreed individually and depend on the condition of the tank, the scope of work and the drying and curing process of the products used.
The stated processing time is an estimate and not a binding fixed date unless a fixed date has been expressly confirmed in writing.
Shipping is usually insured via DHL or a comparable service provider.
The risk passes to the customer when the item is handed over to the shipping company, provided that the customer is an entrepreneur. For consumers, the statutory provisions apply.
We are not liable for delays caused by force majeure, shipping disruptions, failure of suppliers, illness, official measures or comparable circumstances.
5. Services and warranty
We carry out tank restoration work, in particular cleaning, degreasing, derusting, phosphating, sealing, chemical stripping and preparation, to the best of our professional knowledge and using suitable products.
For used, heavily corroded, damaged, leaking or repeatedly treated tanks, we do not guarantee permanent tightness or permanent restoration, as previous damage is not always fully visible or repairable.
The customer is obliged to inspect the returned tank immediately upon receipt, but no later than within 7 days, for completeness, transport damage and obvious defects, and to notify us of any visible defects within this period in writing by email.
For consumers, statutory warranty rights remain unaffected. For consumers, the 7 day period serves the purpose of prompt notification of defects and securing evidence.
In the event of a justified and timely complaint, we may, at our discretion, carry out rectification or retreatment. Further claims exist only in accordance with the statutory provisions.
6. Old coatings, rust and previous damage
Old internal coatings, rust pitting, hidden perforation, previous repairs, soldered areas, welded areas or material weaknesses can make restoration more difficult or affect the durability of the result.
If additional damage or significant extra work becomes visible during processing, we will inform the customer and agree on the further procedure.
If treatment requested by the customer is carried out despite identifiable risks, this is done on the basis of the agreed assessment.
7. Paint, coating and exterior surfaces
Our work primarily serves the cleaning, derusting, stripping and internal treatment of fuel tanks and vehicle tanks.
Depending on condition, material and existing third party coating, chemical, mechanical or thermal work steps may affect exterior paintwork, powder coating, decals, decorations or other surfaces.
Such effects are not technically avoidable in every case and do not constitute a defect in our service, unless exterior paintwork or the external surface was expressly accepted as part of the service.
Liability for damage to exterior paintwork, powder coating, decals or other surfaces exists only in accordance with statutory provisions, in particular in cases of intent, gross negligence, injury to life, body or health, or breach of essential contractual obligations.
8. Retention of title and right of retention
We reserve a statutory lien or right of retention on tanks and items handed over to us until all claims arising from the order have been paid in full.
The customer is not entitled to resell, pledge or otherwise encumber the tank during processing or until full payment has been made.
9. Limitation of liability
We are liable for damages, regardless of the legal basis, only in cases of intent and gross negligence.
In cases of simple negligence, we are liable only for damages resulting from injury to life, body or health and for damages resulting from the breach of an essential contractual obligation.
In the event of a breach of essential contractual obligations, liability is limited to the typical and foreseeable damage under the contract.
Mandatory statutory liability claims remain unaffected.
10. Right of withdrawal for consumers
Consumers generally have a statutory right of withdrawal if a contract is concluded as a distance contract or outside business premises.
For individually manufactured or customer specific services, and for services that have already begun, the right of withdrawal may be excluded or may expire prematurely in accordance with statutory provisions.
If we begin performance at the express request of the consumer before the withdrawal period has expired, the consumer may be obliged to pay compensation for the service already provided up to the time of withdrawal.
The right of withdrawal for services expires in accordance with statutory provisions only when the service has been fully performed and the further statutory requirements have been met.
Statutory consumer rights remain unaffected.
11. Data protection
Personal data is processed exclusively in accordance with statutory provisions.

12. Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Place of performance, jurisdiction and applicable law
German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.
The place of performance and place of jurisdiction is, where legally permissible and if the customer is a merchant, 97421 Schweinfurt, Germany.
14. Severability clause
Should any provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
In all other respects, the statutory provisions apply.
